国务院
国务院关于废止部分涉外法规的通知(附英文)
为了加快实施沿海地区经济发展战略，促进我国沿海地区外向型经济的发展，国务院有关部门根据国务院关于清理涉外法规的部署和要求，对国务院发布或者批准发布的现行涉外方面的行政法规和法规性文件（以下简称法规）进行了清理。清理出来的第一批应予废止的法规17件，经
国务院清理涉外法规领导小组和国务院法制局逐件复查，国务院审议，决定予以废止（法规名称见附件一）。
同时清理出来的第一批自行失效的法规11件，也经国务院清理涉外法规领导小组和国务院法制局逐件进行了复查，现一并附后（法规名称见附件二），以便各地区、各部门全面了解已失效的涉外法规的情况，利于工作。

CIRCULAR OF THE STATE COUNCIL CONCERNING THE ANNULMENT OF A PART
OF REGULATIONS GOVERNING FOREIGN-RELATED MATTERS
(June 18, 1988)
In order to speed up the implementation of the strategy for economic
development in the coastal areas, and to promote the development of
export-oriented economy in the coastal areas of our country, the
departments concerned under the State Council, in accordance with the
planning and requirements of the State Council for the sorting out of
regulations governing foreign-related matters, have undertaken the sorting
out of the existing administrative regulations as well as other regulatory
documents (hereinafter referred to as "the regulations", for short),
promulgated by the State Council or promulgated with the approval of the
State Council. At present, the first batch of seventeen regulations, which
have been sorted out and should be annulled, have been reexamined, piece
by piece, by the Leading Group under the State Council for the Sorting Out
of Regulations jointly with the Bureau of Legislative Affairs of the State
Council and by the State Council; and it is decided to announce the
annulment of the aforesaid regulations (See Annex I for the titles of the
aforesaid regulations). At the same time, the first batch of eleven
regulations, which have become invalid automatically, have also been
sorted out and reexamined, piece by piece, by the Leading Group under the
State Council for the Sorting Out of Regulations jointly with the Bureau
of Legislative Affairs of the State Council; and now these eleven invalid
regulations (See Annex II for their titles) are also included here as
Annex II in order to help various regions and departments concerned obtain
an overall understanding of the condition of those invalid regulations
governing foreign-related matters, thereby facilitating their work.

第一条 为加强社会专职消防组织的建设和管理，保障企业、事业单位、乡镇、社区的消防安全，根据《中华人民共和国消防法》和《山东省消防条例》的规定，结合本市实际，制定本规定。
第二条 本规定所称社会专职消防组织，是指企业、事业单位、乡镇（村）、街道办事处设立的专业消防队伍。
第三条 本规定适用于本市行政区域。
第四条 公安消防机构负责其管辖区域内社会专职消防组织的业务指导工作。
第五条 社会专职消防组织必须贯彻“预防为主、防消结合”的方针，做好本责任区域的防火、灭火工作，并配合公安消防队扑救责任区域以外的火灾及参加其他抢险救援工作。
第六条 社会专职消防组织的建立或撤销，必须经市公安消防机构批准。
社会专职消防组织的消防人员应当经公安消防机构培训，获得上岗证书后，持证上岗。
第七条 乡镇、年国民生产总值超过亿元的村、火灾危险性较大或距城市消防站较远的大中型企业，应当设立社会专职消防组织。
第八条 社会专职消防组织的营房设施，由设立单位根据实际情况，参照《城市消防站建设标准》的规定负责建设。
社会专职消防组织的消防车辆、器材装备，由设立单位依据《城市消防站建设标准》的规定配备，报公安消防机构备案。
第九条 社会专职消防组织应当建立防火责任制，定期对责任区域进行防火检查，督促消除火灾隐患，建立防火档案。对发现的违反消防法律、法规、规章的情形，应当及时提出纠正意见。
社会专职消防组织实行昼夜执勤制度，并加强特殊时期的执勤。执勤人员必须坚守岗位，不得擅离职守。
第十条 社会专职消防组织应当进行消防宣传活动，普及消防常识，检查督促消防安全制度的贯彻落实。
第十一条 对在本责任区域改变生产储存物资的性质以及进行工程项目的新建、扩建、改建的，社会专职消防组织应当向单位领导和有关部门提出保障消防安全措施的意见和建议。
第十二条 社会专职消防组织应当组织消防人员熟悉本责任区域的道路、消防水源和消防重点单位等有关情况，建立必要的业务基础资料档案。
第十三条 社会专职消防组织的执勤、灭火、抢险救援、业务训练，参照《公安消防部队执勤条令》和《公安消防部队训练大纲》的规定执行。
社会专职消防组织应当组织消防人员加强灭火战术、技术的训练，制定本责任区域的重点单位灭火作战方案，并根据实际情况组织实地演练。
第十四条 社会专职消防组织对本责任区域发生的火灾应当立即组织扑救，并向公安消防机构报告。
社会专职消防组织的人员、车辆、器材装备，在火灾扑救、抢险救援以及全市性的消防活动中，应当服从市公安消防机构的统一调度、指挥。
第十五条 社会专职消防组织的人员的伤亡保险和伤残保险由本单位负责办理。
社会专职消防组织人员在业务训练、火灾扑救、抢险救援中受伤、致残、死亡的，按照有关劳动保险或伤亡抚恤的规定办理。符合革命烈士条件的，可以按照《革命烈士褒扬条例》的规定，申报革命烈士。
第十六条 社会专职消防组织为扑救本责任区域外单位的火灾或参加其他抢险救援所消耗的燃料、灭火剂、器材装备等费用，由事故单位按规定予以补偿。
第十七条 本规定具体执行中的问题，由青岛市公安局负责解释。
第十八条 本规定自发布之日起施行。
